Finalismo y formalismo en el concepto marsiliano de ley : la ley y el legislador humanos en el Defensor pacis

Abstract

Este trabajo trata sobre la confluencia de los aspectos material y formal en el concepto marsiliano de ley: la conformidad de la ley a un estandar de justicia, y su promulgación como un “comando coercitivo”. Un análisis de los tres argumentos que atribuyen la autoridad legislativa a “la totalidad de la corporación de los ciudadanos o a su parte más prevalente” (universitas civium aut eius valentior pars) revela la importancia del componente teleológico en el pensamiento político de Marsilio.

The paper deals with the confluence of both the material and the formal aspects in Marsilius’ concept of law: the conformity of law to a standard of justice, and its enactment as a “coercive command”. An analysis of the three arguments attribute the legislative authority to “the whole corporation of citizens or its weightier part” (universitas civium aut eius valentior pars) reveals the importance of the teleological component in Marsilius’ political thought.
